MINUTES OF MEETING OF JUNE 4, 2003, 4:00 P.M., SENIOR CENTER

Meeting called to order at 4:05 p.m. by Chair Paul Banner.
Business Meeting.
- Newcomb Hollow beach clean-up was scheduled for Saturday,
June 7th, 10:00 a.m. This is the last in the program and
all will participate.
- The Buffer Zone Policy/Jurisdictional Opinion was reviewed
and approved with two changes, one concerning review by
Commissioners of opinions made by staff, and removal of
second story addition as a minor activity not requiring a
filing. MOVED by Moe, SECONDED by Reynolds, & CARRIED 7-0.
- The Minutes of the following meetings were approved:
4/28/03, MOVED by Moe, SECONDED by DiBlasio, & CARRIED 7-0.
5/12/03, MOVED by DiBlasio, SECONDED by Page, & CARRIED 7-0.
5/21/03 as amended. MOVED by DiBlasio, SECONDED by Page,
and CARRIED 7-0.
- Mail was reviewed.
- Certificates of Compliance were granted to the following:
Geraldine O'Donnell, 44 Cypress St. MOVED by Moe, SECONDED
by Tesson, and CARRIED 7-0.

5:00. Barbara Boone & Jean Gorecki, RDA, 150 Whitetail Lane,
Map 7, Lot 34.8: Construct dwelling & driveway. Tim Brady presented the plan, noting that only the deck and some of the grading for the driveway are in the buffer zone. He was cautioned that for any tree cutting in the buffer zone or any change in plan, the applicant must come back before the Commission. Dottie Dolan MOVED "that the Conservation Commission make a Determination of Applicability, Negative #3."SECONDED by Cyndi Moe,CARRIED 7-0.
5:15. James & Merri Lynn Todd, NOI, 116 Catboat Road, Map 41,
Lot 88: Construct garage, screened porch, deck & driveway. Chet Lay presented the plan, noting that the area over the septic system had not been brought up to grade properly, but that will be corrected at this time. The property is in the floodplain. Emily Beebe asked Mr. Lay to coordinate a pre-construction meeting with a representative from Audubon and herself to determine how to work around Diamond Back terrapin nesting sites. John DiBlasio MOVED "that the Conservation Commission approve Slade Plan #2003-23 dated 2/24/03, subject to conditions specified." SECONDED by Ginie Page and CARRIED 7-0. Conditions were set. 5:35. Diana Farrandino, NOI, 345 Blue Heron Road, Map 42, Lots 115 & 116: Construct dwelling & driveway. John O'Reilly presented the plan. The property is in the floodplain. Abutter Leyland Scott asked about parking. Commissioners noted that clearing in the buffer zone had commenced before filing with the Commission. Mr. O'Reilly said this was due to an error made by his office in delineating the buffer zone. Most of what was done is landward of the proposed limit of work; a silt fence was installed immediately. Since there has been no word from Natural Heritage and no DEP file number assigned, the hearing was continued to 6/18/03. MOVED by Dottie Dolan, SECONDED by John DiBlasio, and CARRIED 7-0.
5:45. Thomas Martin & Alice Hoffman, NOI, 133 Paine Hollow Road, Map 29, Lot 399: New well & two new septic systems. David Lajoie presented a plan for one well and two septic systems, with the leaching area outside the buffer zone. Again Commissioners noted the cutting of 3 trees without a filing. Mr. Lajoie said this was done by the owner; he had expected the trees to be trimmed only. It was agreed that a policy should be developed in order to handle such situations in a consistent manner. John DiBlasio MOVED "that the Conservation Commission levy a fine of $100.00 on the property owners." SECONDED by Cyndi Moe and CARRIED 6-1. John DiBlasio MOVED "that the Conservation Commission approve Felco Plan #02148
dated 4/15/03, subject to conditions specified." SECONDED by Dottie Dolan and CARRIED 7-0. Supervisor: Emily Beebe.
6:10. Irmgard Boriskin, NOI, 101 Commercial Street, Map 21,
Lot 127: Construct garage with apartment & septic system. Future
demolition of restaurant building and replacement with dwelling.
David Lajoie presented the plan. The property, abutting Duck Creek and a salt marsh, is 5 acres, with 1 acre of upland, and is land subject to coastal storm flowage. Dottie Dolan questioned the siting of the new dwelling when there is ample room to move it back from the bank. Emily Beebe noted that new construction is proposed in the 50 foot buffer strip. Ms. Boriskin said they want the dwelling to be where the restaurant is, using that foundation.
It was explained that it is not possible to use the restaurant foundation because of current regulations governing construction in a floodplain. Ginie Page said Commissioners want the dwelling moved back from Duck Creek. She also noted that the proposed dwelling is bigger than the restaurant. Ms. Boriskin responded that it would however be a residential rather than a commercial use and thus less intensive. There was discussion of the house being moved over. It was agreed that the hearing should be continued to 7/2/03, and that clearer definition of the buffer zone and the floodplain should be provided. 6:35. Laurie Holmes & Elba Aviles, NOI, 155 Samoset Road, Map 28,
Lot 103: Construction of Addition; removal of garage & foundation.
David Lajoie presented the plan for an addition and for removal of the garage and capped foundation. Emily Beebe said a landscape plan filed by the prior owner is still in effect and has no relation to work done recently in front of the house and on the
bank. Also, the revetment built by the prior owner has unauthorized steps. No response has been received from Natural Heritage, and it was agreed that the hearing should be continued to 7/2/03, with a possible change in the delineation of the coastal bank to be checked and the 50 foot buffer strip to be noted on the plan. MOVED by Cyndi Moe, SECONDED by Dottie Dolan, and CARRIED 7-0.
6:50. Mark & Karen Addesso, NOI, 12 Ione Road, Map 28, Lot 57:
Replace existing dwelling. David Lajoie presented the plan, which keeps the existing foundation. A 2-foot extension of the deck will be cantilevered, and the sunken stone patio with retaining wall under the deck is to be kept. Environmental consultant Paul Shea, representing a group of abutters, noted the increase in the number of bedrooms with reference to increased flow into the leach field, which is entirely within the 50 foot buffer strip, and asked if Board of Health approval had been given. Peter Hall, representing the Wellfleet Conservation Trust, asked that the hearing be continued so that they would have time to look at the proposal more closely. In the absence of a response from Natural Heritage, it was agreed to continue the hearing to 7/2/03. MOVED by Moe, SECONDED by DiBlasio, and
CARRIED 7-0.
Other Business.
- It was noted that at 155 Samoset Avenue, the former MacArthur
property, now Holmes/Aviles, there are two problems:
(1) unauthorized steps built into the new revetment; (2) wooden
walkways, landing and stairs made of pressure-treated wood
laid down right on the sand. The coastal bank has been cut
into and vegetation ripped out. An Enforcement Order will be
issued.
